Do You Qualify for DACA?
As the name suggests, DACA is intended to benefit those who arrived in the United States as children. Most children followed their parents into the United States without permission. For this reason, these childhood arrivals remain undocumented even though they may be adults at this point.
The United States Citizenship and Immigration Services (USCIS) set the following eligibility criteria for anyone seeking DACA protection:
- You arrived in the United States before you were 16 years of age.
- You have continuously lived in the United States since June 15, 2007, up to the present.
- You must have been physically present in the United States on June 15, 2012, and when you submit your application.

- You must be either currently enrolled in school or have graduated with a diploma or GED, or you must be honorably discharged from the Coast Guard or U.S. Armed Forces.
- You must undergo a background check and provide biographic data and information to USCIS.

Should You Request DACA Protection?
This is an individualized choice. We encourage people to think about their alternatives. For example, you might return to your “home” country and seek an immigrant or nonimmigrant visa instead. Everything depends on your goals and present circumstances.
Remember, DACA is not an immigration status. It simply protects you from deportation during your two-year period, while providing the opportunity to legally work and study inside the United States. Renewing Your DACA Status

Fighting a Termination or Non-Renewal
Each year, thousands of people successfully renew DACA. Renewal is necessary because DACA provides only temporary protection. Anyone who fails to renew will be eligible for deportation.
Some people are denied renewal. For example, you might not have submitted all the required supporting documents. You should review your rejection notice from USCIS. It might be possible to fix the flagged issues and then resubmit.
